When you are a litigant in a custody case, you must be mindful of every action and inaction that you make. If you write in a journal or leave your children notes pertaining to adult issues involving litigation, be cognizant that your journal and/or the notes to your children may be used against you in your custody litigation.
Injecting children into litigation is never a good idea
Any commentary that is less than edifying pertaining to the other parent simply should not be made, much less written. Insulating your children from the stress and chaos that is often associated with emotional custody litigation is the best course of action.
